Damn Video

Terms of Service

Effective date: [to be set at launch]

1. Acceptance of Terms

By using Damn Video (“Service”), you agree to these Terms. If you do not agree, you must not use the Service. These Terms are an agreement between you and [Damn Video LLC — confirm legal name], a [State] [type of company, e.g. limited liability company] (“Damn Video,” “we,” “us”). If you use the Service for a company or other organization, you’re agreeing for it, and “you” means that organization too. You must be at least 18 to use the Service.

2. Description of Service

Damn Video provides lightweight video hosting via direct MP4 links for website integration purposes. You upload a video and get a link to put on your website. Videos are stored and delivered by our provider Bunny.net. Playback links are signed and expire, and you can choose to let your videos play only on your own domains. The Service also includes team workspaces, no-login upload links you can share, and a connection (an MCP server) that lets AI apps work with your account.

3. Account Responsibility

You are responsible for maintaining your account security and all activities that occur under your account. Each account is a workspace with an owner, who can add team members as admins or members. That responsibility covers what your team members do, what people upload through links you share, and what AI apps and API keys you connect do on your behalf. Keep your sign-in details accurate and private, and tell us right away at support@damnvideo.co if you think someone has gotten into your account.

4. Plans and Payments

Hosting is billed monthly. Payment is required to maintain active hosting. The plans are:

Current prices and limits are always on our pricing page. Prices are in US dollars and don’t include any taxes that apply.

5. Cancellations

You may cancel at any time through your account dashboard. Your plan stays active until the end of your trial or current billing period, then ends. When a plan ends or lapses, your videos stop playing, but we keep the stored files until you delete them. Start a plan again and they play again.

Refunds: because every workspace starts with a free trial, payments for a billing period that has already started aren’t refunded, except where the law requires it. [Confirm refund rule]

6. Intellectual Property

You retain rights to your uploaded content. We only store and deliver your video files as part of the Service. To do that, you give us permission to store, copy (for example, to our replica location) and deliver your videos and their details, only as needed to run the Service for you. That permission ends when you delete the content. The Service itself, including our software, design and the Damn Video name, belongs to us.

7. Acceptable Use

You agree not to use the Service to:

We may remove content or suspend an account that breaks these rules.

8. Plan Limits

Each plan limits how many videos can be active at once, how much bandwidth your videos can use each month, and how much storage you can use. At a limit, you can’t make more videos active or upload past your storage, and when the monthly bandwidth limit is reached, your videos may stop playing until the next month or until you upgrade. Usage figures in your dashboard are worked out once a day from our delivery network’s logs, so they can run about a day behind.

9. Upload Links

Upload links let anyone who has the link add a video to your workspace without signing in. Share them only with people you trust. Anything uploaded through your link counts as your content under these Terms, and against your plan’s limits.

10. AI Apps and API Keys

You can connect AI apps (such as Claude) to your account through our MCP server, by signing in to approve them (OAuth) or with an API key you create. A connected app can do what your account allows, including uploading and deleting videos, so connect only apps you trust and keep your API keys secret. You can disconnect apps and revoke keys at any time in your dashboard. Those apps are run by other companies under their own terms, and we aren’t responsible for what they do.

11. Copyright Complaints

We respect copyright. If you believe content hosted on Damn Video infringes your copyright, send a notice to support@damnvideo.co or by mail to [Mailing address]. Include:

We’ll remove or disable content that a valid notice identifies and tell the customer who uploaded it. If you believe your content was removed by mistake, you can send a counter-notice to the same address. We close the accounts of repeat infringers.

12. Suspension and Termination

You can stop using the Service and cancel at any time. To delete your account and its data, email support@damnvideo.co. We may suspend or close your account if you break these Terms, if your payment can’t be collected, or if the law requires it. Where we reasonably can, we’ll tell you first and give you a chance to fix the problem.

13. No Warranty

We work hard to keep Damn Video running, but the Service is provided “as is” and “as available.” We don’t promise it will be uninterrupted or error free, and it depends on providers like Bunny.net, Stripe, Vercel and Neon. Keep your own copies of your videos. To the extent the law allows, we disclaim all other warranties.

14. Limitation of Liability

To the extent the law allows, Damn Video isn’t liable for indirect or consequential losses, such as lost profits, revenue or data. Our total liability for any claim about the Service is limited to the amount you paid us in the 12 months before the claim.

15. Indemnity

If someone makes a claim against us because of your content or your use of the Service in breach of these Terms, you agree to cover our reasonable costs of dealing with it, including legal fees.

16. Governing Law

These Terms are governed by the laws of the State of [State]. Any dispute will be handled in the courts located in [County, State].

17. Changes to These Terms

We may update these Terms. If a change is significant, we’ll tell you by email or with a notice in your dashboard before it takes effect. Using the Service after that means you accept the new Terms.

18. General

These Terms, together with our Privacy Policy, are the whole agreement between you and us about the Service. If any part is found unenforceable, the rest still applies. Not enforcing a part right away doesn’t mean we give it up. You can’t transfer these Terms to someone else without our consent; we may transfer them if Damn Video is sold or merged.
